The following Terms and Conditions establish a binding agreement between you and HeyHi ("www.heyhi.app," "we," or "us"). Together with the Site Policies, these documents are collectively referred to as the "Agreement" and as the "Terms of Service" or "Terms." By accessing or utilizing the services available on the domain and sub-domains of www.heyhi.app (the "Site"), you are acknowledging and agreeing to be bound by this Agreement.
We recommend that you periodically review the Terms and Conditions along with any associated information for updates, as we may make revisions to these Terms from time to time. You are responsible for regularly checking these Terms for any changes. The latest version of these Terms supersedes any previous versions. By using HeyHi, you fully accept all revisions or amendments to these Terms and Conditions.
"HeyHi" refers to the language practice platform operated by SAIC Motors Group DOO.
"User" denotes individuals utilizing HeyHi for language practice purposes.
"Tutor" refers to individuals who provide language practice sessions on HeyHi's platform. Tutors on HeyHi include individuals who are blind, visually impaired, or permanently disabled, and who offer their expertise to facilitate language learning.
"Session" signifies scheduled interactive language exchange experiences between users and tutors.
"Content" encompasses text, images, audio, video, and other materials available on HeyHi.
During HeyHi's initial phase, all users can enjoy complimentary language practice sessions.
Pricing information for post-launch sessions will be communicated in due course.
HeyHi reserves the right to modify, suspend, or terminate any aspect of the HeyHi platform, including its services and features. Any new additions or alterations to the platform, including but not limited to the introduction of new services, will be subject to the terms outlined in this Agreement.
We strive to maintain the continuous availability of the HeyHi platform, but we cannot guarantee uninterrupted operation or absence of interruptions. HeyHi will not be held liable for any disruptions or errors in the platform's functioning. Users are strictly prohibited from attempting to interfere with the proper operation of the platform, and must refrain from circumventing security measures, tampering, hacking, or disrupting any computer system, server, platform, or internet-connected device associated with HeyHi.
Users are responsible for ensuring their compatibility with the HeyHi platform, including adhering to the technical specifications required for seamless usage. It is the users' responsibility to implement appropriate procedures, including security measures like anti-virus checks, to safeguard their data input and output accuracy. HeyHi cannot guarantee that the platform will be free from viruses, bugs, or any other potentially destructive elements.
Users should periodically review the Terms and Conditions of HeyHi to remain informed about any updates. HeyHi may make changes to these terms as necessary. Continued use of the platform following updates to the Terms and Conditions will signify your acceptance of the revised terms. Users are responsible for staying informed about any modifications or amendments.
By utilizing HeyHi, you acknowledge and fully accept any revisions, amendments, or updates to these Terms and Conditions. Your continued use of the HeyHi platform demonstrates your consent to any such changes.
The HeyHi platform is operated and managed from our offices in Serbia. We do not assert that the platform or its content is suitable or accessible for use in all countries. Visitors from other countries access the platform at their own discretion and risk.
By posting content covered by intellectual property rights, such as photos and videos (IP content), on the HeyHi platform, you grant HeyHi a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use the IP content in connection with the platform, as well as on Facebook, Google, or Twitter, subject to your privacy and application settings. This license persists unless you delete your IP content or your account, except in cases where others have shared your content and not deleted it.
HeyHi may include hyperlinks to websites operated by third parties on the internet. These websites are believed to offer services and/or products that complement the offerings of HeyHi. However, HeyHi makes no representations or warranties regarding the content of these external websites.
When a User clicks on an external link, they acknowledge that the linked website is independent of HeyHi's platform. HeyHi does not exert control over the content, availability, or practices of these external sites.
The presence of a hyperlink to another site does not imply that HeyHi endorses or assumes responsibility for the content or usage of that site. Users accessing external sites do so at their own discretion and risk.
HeyHi shall not be held liable for any loss, damage, or harm, whether real or alleged, arising from the use of or reliance on any content, goods, or services provided by or through external websites linked to HeyHi's platform.
If you have concerns or queries regarding an external link provided on HeyHi's platform, please direct them to the respective site administrator or webmaster of the linked website.
To participate in HeyHi's Practice Sessions, Users are required to register with us. Any personal information provided during the registration process or any interactions with HeyHi will be collected, stored, and used in accordance with our Privacy Policy.
Users must register with a valid personal email address that they regularly access. This enables HeyHi to send moderation emails. Registrations using someone else's email or temporary addresses may lead to termination without prior notice. HeyHi may require Users to re-validate their registration if the provided email is deemed invalid. Registration using proxy IPs to hide the origin is subject to termination.
Users are expected to adhere to the following rules when using instant messaging and Practice Sessions services ("the Guidelines"):
Users are strictly prohibited from using the instant messaging facility to submit or share defamatory or illegal material, including text, graphics, videos, programs, or audio. Submitting or sharing content with the intent of committing or promoting illegal activities is strictly forbidden. Users commit to sharing their original work only and must not violate or infringe the rights of third parties, including copyright, trademark, trade secrets, privacy, publicity, or personal and proprietary rights.
HeyHi reserves the right to remove any content or account that is deemed vulgar, contrary to the ethos of language learning, infringing or violating intellectual property or other proprietary rights, or breaching these Terms and Conditions. Such actions may be taken without prior notice, compensation, or refund.
The views expressed by Users are their own, and unless explicitly stated, they do not reflect our opinions. We are not liable for any information provided by Users via the Site.
We disclaim responsibility for the availability or content of third-party sites accessible through the Site. Links to third-party websites from the Site do not constitute endorsement, and Users use such sites at their own risk.
The Site and all its materials, including information, names, images, pictures, logos, and icons related to us, our products, and services (or third-party products and services), are provided "AS IS" and on an "AS AVAILABLE" basis. We exclude all representations, warranties, and endorsements (whether express or implied by law), including implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy. You shall not transfer, assign, or delegate your rights or obligations (including your Account) under the Terms and Conditions to anyone without the express written permission of HeyHi, and any such attempt shall be null and void. HeyHi may assign this Agreement at its discretion.
HeyHi reserves the right to terminate your access to the entire Site or any portion thereof at any time, with or without cause, and with or without prior notice, effectively immediately. If you desire to terminate this Agreement or your heyhi.app account (if applicable), you may do so by ceasing to use the Site. All clauses of this Agreement that, by their nature, should survive termination will continue to remain in effect after termination. This includes but is not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
